BAGONG REGULASYON NG CHINESE COAST GUARD, IKINABABAHALA NG DFA

Manila Philippines — Nagpahayag ng pagkabahala ang Department of Foreign Affairs (DFA) hinggil sa bagong regulasyon na ibinaba ng Beijing sa Chinese Coast Guard.

Ayon DFA, hindi umano maaaring ipatupad sa teritoryo, maritime zones o hurisdiksyon ng ibang bansa ang “Regulations on Administrative Law Enforcement Procedures for Coast Guard Agencies” ng Beijing na inaatasan ang CCG na arestuhin ang mga Pilipinong mangingisda sa inaangking teritoryo ng China.

“…a state’s domestic laws may not be applied and enforced in the territory, maritime zones or jurisdiction of other states, nor violate other sovereign states’ rights and entitlements under international law. These same domestic laws cannot be applied nor enforced in the high seas under international law,” ayon sa pahayag ng DFA.

Nilalabag din daw ng China ang international law sa illegal, walang bisa at pinalawak na 10-dash line kung saan kabilang sa sinasakop ng China ang bahagi ng West Philippine Sea.

“China would be in direct violation of international law should it enforce these new regulations in the waters and maritime features within the illegal, null and void, and expansive 10-dash line, which would effectively cover areas of the West Philippine Sea where the Philippines has sovereignty, sovereign rights and jurisdiction, or in the high seas,” dagdag pa ng DFA.

Pinaalalahanan din ng DFA ang China na sumunod sa international law at kanilang obligasyon sa ilalim ng UN Convention on the Law of the Sea (UNCLOS), 2016 Arbitral Binding, at sa 2022 Declaration on the Conduct of Parties in the South China Sea (DOC).

“We reiterate our call for China to comply with international law and desist from any action that would undermine peace and security in the region,” sabi pa ng DFA.

Inaprubahan ang naturang bagong regulasyon noong May 15, 2024 at magiging epektibo ang implementasyon nito sa June 15, 2024.

Nagpahayag din ng pagkondena ang P1NAS o Pilipinong Nagkakaisa para sa Soberanya sa bagong regulasyon ng China.

“China is brazenly asserting its unlawful claim over the entire South China Sea through these outrageous regulations,” ayon ka P1NAS spokesperson Antonio Tinio.

Una na ring kinondena ng Department of National Defense (DND) ang nagaatas sa mga CCG na arestuhin ang mga mangingisdang nanghihimasok umano sa teritoryo patuloy na inaangkin ng China.
