COMELEC JUNKS 2ND DISQUALIFICATION CASE VS. ERWIN TULFO

Manila, Philippines — In its recent decision, the Commission on Elections First Division has formally dismissed another disqualification case filed against ACT-CIS Partylist representative and senatorial aspirant Erwin Tulfo.

Based on the three-page decision, COMELEC first division junked the disqualification petition against Tulfo, which was filed by disbarred lawyer Berteni Cataluña Causing at Graft-free Philippine Foundation Incorporated, represented by Diosdado Villar Calonge.

COMELEC said that the petitioner failed to comply with the requirement under Resolution No.11046 regarding the observance of the necessary procedures.

The decision particularly stated that the petitioner failed to submit proof of service of the petition with complete annexes to the respondent or failed to execute an affidavit of service.

Hence, this explained that there is no proof whether the response received a copy of the petition.

The dismissal of this case marked the 2nd disqualification petition against Tulfo that was junked by the Commission.

The first was the DQ case filed against the Tulfo siblings over an alleged political dynasty.

Following this, Tulfo once again expressed gratitude to COMELEC for the swift decision over the case, as well as to his supporters.
