Manila, Philippines – A Pasay City Regional Trial Court junked the petition of controversial contractor Curlee Discaya for a habeas corpus grant.
The court decision says that there is no sufficient proof to back Discaya’s claims about grave abuse of discretion in relation to his Senate detention.
It can be recalled that on September 17, the Senate Blue Ribbon Committee cited Discaya in contempt after ‘lying’ during the flood control scandal inquiry.
Following the denial of his bid, Discaya will remain in detention under Senate custody, with the Chamber insisting that the contempt order was aligned with constitutional authority.
On Wednesday, spouses Curlee and Sarah Discaya appeared before the Independent Committee for Infrastructure (ICI) in relation to the investigation, where the two manifested that this would be their last appearance at will not participate with ICI’s inquiry anymore.
Based on their joint affidavit, the spouses feel like they are being pressured to be convicted in the case.
ICI Executive Director Atty. Brian Hosaka on the other hand said that the Discayas withdrew their participation after hearing that they will not be qualified as state witnesses.
Hosaka clarified that any official information and announcement regarding the investigation should only come from the commission.
