SC DECLARES IMPEACHMENT ARTICLES VS. VP SARA ‘UNCONSTITUTIONAL’

Manila, Philippines – The Supreme Court on Friday (July 25, 2025) declared the articles of impeachment filed against Vice President Sara Duterte unconstitutional.

Spokesperson Atty. Camille Ting announced SC’s decision on the petition citing violation on one-year bar rule and due process for an impeachment complaint.

Under the Philippine Constitution, the one year bar rule states that no impeachment proceedings shall be initiated against the same official more than once within a year.

Ting emphasized that the law is clear and that due process must always be upheld.

It can be recalled that three impeachment complaints were filed against Duterte in December 2024. Th3 fourth impeachment, however, was the one approved by the House of Representatives and endorsed to Senate.

Following the decision, the Senate cannot acquire jurisdiction over the impeachment proceedings.

The High court, however, clarified that the decision does not absolve Duterte of any charged filed against her as a new impeachment complaint against her may be filed next year, starting February 6, 2026.
